Welcome to Catalight® Classroom, provided by Catalight Foundation, a California non-profit corporation, with its principal place of business located at 2730 Shadelands, Dr Bldg. 10, Walnut Creek, CA 94598 (“Catalight”) through its Talent LMS® platform Catalight® Classroom By accessing and participating in our Courses and Programs you agree to abide by the following Terms of Service. Please read these terms carefully before proceeding.
By registering for and/or using our Courses and Programs on Talent LMS, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.
The specific details and scope of services are outlined on catalightclassroom.org. To access the applicable terms, navigate to the Program & Courses section and select the appropriate course from the drop-down menu.
To access our Courses and Programs, you must complete the registration process, providing accurate and complete information. You are responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account.
All content provided in our Courses and Programs, including text, graphics, logos, images, and software, is the property of Catalight® Classroom. You are expressly prohibited from copying any of the Company's copyrighted materials, using the Catalight® Classroom 's trademarks, trade names, service marks, or any other intellectual property designations in any promotional materials, publications, or any form of advertisement or public display, or from using video, audio, or other forms of recording equipment during Sessions without prior written consent from the Catalight® Classroom. These restrictions include all forms of copying, both digital and physical, all uses of intellectual property for promotion, and any recording of sessions, irrespective of purpose. Failure to comply with these terms will subject the Provider to legal enforcement, You may use any training manuals outside of the Catalight® Classroom course for the limited purpose of providing treatment to your own client and for any necessary training related to the Catalight Classroom.
You may have the opportunity to participate in forums, discussions, and other interactive areas. By submitting content via the Catalight® Classroom, all copyrightable material, notes, records, drawings, designs, inventions, improvements, developments, discoveries and trade secrets conceived, discovered or developed (“Catalight IP”) during any Catalight® Classroom are the sole property of the Catalight. Catalight grants you a non-exclusive, worldwide, royalty-free license to use Catalight IP during any Catalight® Classroom course.
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
We reserve the right to terminate or suspend your access to our courses at our sole discretion, without notice, for conduct that we believe violates these terms or is harmful to other users.
You agree to indemnify, defend, and hold harmless the Catalight, its affiliates, officers, agents, employees, and successors from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees and costs) that such parties may incur as a result of or arising from the participation in the Catalight® Classroom.
We do not guarantee any specific outcomes, such as promotions, raises, or career advancements, by completing the purchased Courses and Programs. Your success depends on a variety of factors, including your own efforts and the policies of your employer, if applicable.
We make no warranty whatsoever regarding the services or content provided through the Catalight® Classroom, including any (a) warranty of merchantability; (b) warranty of fitness for a particular purpose; or (c) warranty against infringement of intellectual property rights of a third party; whether arising by law, course of dealing, course of performance, usage of trade, or otherwise. provider acknowledges that it has not relied on any representation or warranty made by Catalight, or any other person on Catalight's behalf. In no event shall Catalight be liable for any consequential, indirect, incidental, special, exemplary, or punitive damages, lost profits or revenues or diminution in value, arising out of, relating to, and/or in connection with participation in the Catalight® Classroom, regardless of (a) whether such damages were foreseeable, (b) whether or not company was advised of the possibility of such damages and (c) the legal or equitable theory (contract, tort or otherwise) upon which the claim is based.
In no event shall Catalight's aggregate liability arising out of or related to participation in the Catalight® Classroom, whether arising out of or related to breach of contract (including breach of warranty), tort (including negligence), or otherwise, exceed the total amounts fees paid to Catalight for participation in the Catalight® Classroom.
We may modify these Terms of Service at any time. Any changes will be effective immediately upon posting. Your continued use of our Courses and Programs after changes are posted constitutes your acceptance of the new terms.
You acknowledge that full payment of course fees does not guarantee the successful completion of the course or the receipt of any credential. If You fail to meet the necessary requirements, complete the coursework, or do not fulfill the criteria to receive the certificate, no refund of course fees will be issued. All fees paid are non-refundable, regardless of Your performance or completion status.
These terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
